O silêncio é um dos muitos modos de comportamento do réu no procedimento penal. Sobre o silêncio, objeto da pesquisa, recai um leque normativo que demanda a respectiva construção das balizas do instituto. Assim, o exercício desse direito enfrenta consequências legais; ao passo que também levanta um leque de garantias, constitucionais e infraconstitucionais. Parâmetros advindos do Direito Internacional, que garantiriam ao réu a liberdade de exercer sua defesa em plenitude, são outros elementos que devem sempre ser levados em conta à normatividade tratada. Saber como o ordenamento brasileiro permite e limita o instituto, ao lado do que dispõe o Direito Internacional, será conhecer os limites de um dos mais básicos e antigos comportamentos de defesa do réu: o seu silêncio. Exceções e especialidades presentes no ordenamento brasileiro, além de brechas e considerações jurisprudenciais também demandaram uma estrita leitura e interpretação das normas que disciplinam o instituto: tudo para a construção do regime jurídico que preside o exercício desse direito, especificamente no procedimento penal. Por último, o interesse na pesquisa também resultou na constatação de que esse direito sofre proteções e consequências jurídicas adversas quando comparado o quadro jurídico brasileiro ao que se encontra em alguns outros ordenamentos, conforme será demonstrado. A metodologia de pesquisa será bibliográfica e documental. As principais conclusões do trabalho passarão pelos limites legais ao exercício do direito ao silêncio, atingindo assim uma construção de seu regime jurídico.

Silence is one of the many ways in which defendants behave in criminal proceedings. On silence, the object of the research, there is a normative range that demands the respective construction of the institute¿s boundaries. Thus, the exercise of this right faces legal consequences; while also raising a range of guarantees, constitutional and infra-constitutional. Parameters arising from International Law, which would guarantee the defendant the freedom to exercise his defense in full, are other elements that must always be taken into account in the normativity dealt with. Knowing how the Brazilian Legal System allows and limits the institute, in addition to the provisions of International Law, will be to know the limits of one of the most basic and oldest behaviors in defense of the defendant: his silence. Exceptions and specialties present in the Brazilian Legal System, in addition to loopholes and jurisprudential considerations, also demanded a strict reading and interpretation of the rules that govern the institute: all required for the construction of the legal regime that rules the exercise of this right, specifically in criminal proceedings. Finally, the interest in the research also resulted in the finding that this right has protections and adverse legal consequences when comparing the Brazilian legal framework to that found in some other Ordinances, as will be shown. The research methodology will be bibliographical and documentary. The top conclusions of the paper will go through the legal limits to the exercise of the right to silence, thus reaching a construction of its legal regime.
