A tese principal do presente estudo é a de que um conjunto de princípios constitucionais impõe a inclusão das uniões homoafetivas no regime jurídico da união estável, por se tratar de uma espécie em relação ao gênero. A tese acessória é a de que, ainda quando não fosse uma imposição do texto constitucional, a equiparação de regimes jurídicos decorreria de uma regra de hermenêutica: na lacuna da lei, deve-se integrar a ordem jurídica mediante o emprego da analogia. Como as características essenciais da união estável previstas no Código Civil estão presentes nas uniões estáveis entre pessoas do mesmo sexo, o tratamento jurídico deve ser o mesmo.

The main thesis of the present study is that a set of constitutional principles imposes the inclusion of same-sex unions in the legal regime of the stable union, as it is a species to the genus. The accessory thesis is that, even when it was not an imposition of the constitutional text, the assimilation of legal regimes would result from a rule of hermeneutics: in the gap of the law, one must integrate the legal order through the use of analogy. As the essential characteristics of the stable union provided for in the Brazilian Civil Code are present in stable unions between persons of the same sex, the legal treatment must be the same.
