Entende-se que a cautela maior na atuação do Ministério Público e, finalisticamente, do próprio Juiz, nos Juizados Especiais Criminais federais ou estaduais, reside no fato de o TAC ter sido celebrado com os outros legitimados, v.g., União, Estados e Municípios porque nem sempre será de prévio conhecimento, além do que os acordos podem não ser suficientemente abrangentes em relação ao dano ambiental. Nessa última hipótese, cai por terra qualquer contra argumento do agente ativo da infração penal no sentido de que já estipulou acordo para reparar o dano causado, por exemplo, com o Município e, portanto, o pré-requisito da composição civil já está plenamente satisfeito e acabado.
