Além da função de auxílio ou substituição dos Procuradores de Justiça, os Promotores poderão postular aos tribunais estaduais nas situações mencionadas no art. 32, I, da Lei nº 8.625/93.Somente é admissível que o Promotor de Justiça maneje os instrumentos previstos no art. 32, da lei supracitada a partir de uma posição de inércia do tribunal, não tendo atribuição para utilizá-los quando o ponto de partida for justamente um ato do tribunal ou dos órgãos que o integram, o que transfere a atribuição aos Procuradores de Justiça. Quanto ao escalonamento funcional dos membros do Ministério Público, esta não é uma tarefa disciplinada pela Constituição da República, sendo, assim, relegada ao legislador infraconstitucional.

In addition to the function of assisting or replacing the Attorneys of Justice, the Prosecutors may apply to the state courts in the situations mentioned in art. 32, I, of Brazilian Law No. 8.625 / 93. It is only permissible for the Prosecutor to handle the instruments provided for in art. 32, of the aforementioned law from a position of inertia of the court, having no attribution to use them when a starting point is precisely an act of the court or of the bodies that integrate it, which transfers the attribution to the Attorneys of Justice. As for the functional scheduling of members of the Public Prosecution Service, this is not a task regulated by the Brazilian Constitution of the Republic and is thus left to the infraconstitutional legislator.
