Restará configurado o abuso de poder sempre que o exercício de um direito prejudicar o direito de igualdade que deve nortear o procedimento eletivo, comprometendo sua normalidade e legitimidade. Serão abusivos todos os atos que exorbitem o ponto de equilíbrio que deve estar presente entre o exercício de um direito e a garantia de igualdade, sempre que estiverem revestidos de potencialidade para afetar a identidade que deve existir entre a vontade do colégio eleitoral e o resultado do pleito, arcando com as consequências do ato tanto aquele que o praticou como seu beneficiário, ainda que não se logre demonstrar a participação deste.

Abuse of power will remain configured whenever the exercise of a right undermines the right to equality that should guide the elective procedure, compromising its normality and legitimacy. All acts that exorbitate the point of balance that must be present between the exercise of a right and the guarantee of equality will be abusive, whenever they have the potential to affect the identity that must exist between the will of the electoral college and the result of the election claim, bearing the consequences of the act both the one who practiced it and its beneficiary, although it is not possible to demonstrate its participation.
