O trabalho em comento pretende focar os aspectos teórico-fáticos que permearam o caminho percorrido para a erradicação da tração animal na Ilha de Paquetá. A perfunctória digressão histórico-cultural da tração animal que remonta ao período da Sesmaria, por si só, decifraria o arraigado posicionamento favorável à manutenção das charretes. A total ausência de políticas públicas contribuiu para o macabro cenário degenerado por gravíssimas infrações de cunho ambiental. A miríade de posicionamentos divergentes obstaculizou o encontro de uma solução simples ao conflito, o que, por óbvio, atrasou significativamente a solução e execução da quaestio juris. O trabalho foi realizado pela 19ª Promotoria de Investigação Penal da 1ª Central de Inquéritos. Seria lícita a intervenção do Poder Judiciário para pôr fim à tração animal em Paquetá como meio de resolução judicial de conflito, caso a solução extrajudicial não tivesse se mostrado eficaz? A que se deveu a ausência do fenômeno backlash no caso em comento? A fim de complementação da sistemática, apresentamos a única solução judicial viável como sendo aquela que a melhor doutrina resolveu chamar de processo estruturante, enumerando as respectivas características tipológicas. O estudo de caso se assenta em pesquisa de campo realizada pela autora durante o longo lapso temporal em que foi titular da 19ª PIP da 1ª CI, cuja área de abrangência compreendia a 32ª Delegacia Policial (Jacarepaguá) e a Delegacia de Proteção ao Meio Ambiente (DPMA), na Cidade da Polícia. O caminho percorrido e a solução eleita (a erradicação por completo da tração animal) na Ilha de Paquetá, desprovida da judicialização da matéria encontram amparo jurídico, mormente se observarmos os matizes do Estado Democrático de Direito?

The work under discussion intends to focus on the theoretical-factual aspects that permeated the path taken to eradicate animal traction on the Paquetá Island. The perfunctory historical-cultural digression of animal traction that goes back to the period of Sesmaria, by itself, would decipher the ingrained position favorable to the buggies maintenance. The total absence of public policies contributed to the gruesome scenario, degenerated by very serious environmental nature violations. The myriad of divergent positions made it difficult to find a simple solution to the conflict, which, obviously, significantly delayed the solution and execution of the quaestio juris. The work was carried out by the 19th Prosecutor's Office of Criminal Investigation of the 1st Central of Inquiries. Would it be licit for the intervention of the Judiciary Power to put an end to animal traction in Paquetá, as a means of judicial resolution of conflict, in case the extrajudicial solution had not proved to be effective? What was the cause for the absence of the backlash phenomenon in the case under discussion? For the purpose of complementing the systematics, we present the only viable judicial solution as being the one that the best doctrine decided to call as structuring process, enumerating the respective typological characteristics. The case study is based in field research carried out by the author during the long temporal lapse in which was holder of the 19th PIP of the 1st CI, whose coverage area comprised the 32nd Police Station (Jacarepaguá) and the Environment Protection Police Station (DPMA), in the Police City. The path taken and the elected solution (the complete eradication of animal traction) on Paquetá Island, devoid of the judicialization of the matter find legal support, mainly if we observe the hues of the Democratic Rule of Law?
