Este artigo tem por objetivo apresentar algumas considerações acerca da alteração introduzida pela Lei nº 13.964/2019 (Pacote Anticrime), que incluiu o parágrafo 5º ao artigo 171 do Código Penal, passando a condicionar, como regra, a ação penal do crime de estelionato à representação da vítima (ou de seu representante legal ou de seu sucessor), de forma a aprofundar o debate sobre alguns aspectos relevantes, à luz das soluções até agora apresentadas pela doutrina e jurisprudência, sob uma perspectiva focada na proteção dos direitos humanos e no seu controle de convencionalidade e constitucionalidade, no tocante à extensão e consequências da aplicação da nova normativa aos fatos anteriores à vigência da lei, ao emprego da analogia para intimação da vítima para oferecimento da representação e ao exaurimento do prazo para seu oferecimento, circunstância a ensejar o reconhecimento da extinção da punibilidade pela decadência.

This article aims to present some considerations about the amendment introduced by Brazilian Law nº 13.964/2019 (Anti-Crime Package), which included paragraph 5 to article 171 of the Brazilian Penal Code, starting to condition, as a rule, the criminal activities of the crime of embezzlement to the representation of the victim (or their legal representative or successor), to deepen the debate on some relevant aspects, in the light of the solutions so far presented by doctrine and jurisprudence, from a perspective focused on the protection of human rights and their control of conventionality and constitutionality, concerning the extent and consequences of the application of the new regulation to facts before the effectiveness of the law, the use of the analogy to subpoena the victim to offer the representation and the exhaustion of the term for its offer, a circumstance that gave rise to the acknowledgment of the extinction of punishment by decay.
