O presente trabalho pretendeu focar no êxito da parceria do Núcleo de Proteção Animal (NPA) do Rio de Janeiro com a classe emergente de "Protetores" lato sensu, incluindo-se neste contexto as ONGs que atuam neste campo. Após perfunctória digressão histórica acerca do surgimento deste novo segmento de proteção animal, procurou-se identificar os aspectos positivos derivados desta inédita aliança, sem olvidar da abordagem quanto a sua regularidade e legalidade em face das normas internacionais, principalmente a Declaração Universal dos Direitos do Animais (D.U.D.A) e Ordenamento Jurídico interno, vale dizer, a Magna Carta de 1988 e outras legislações infraconstitucionais que tratam do tema. A Teoria dos Movimentos Sociais teve grande contribuição no caminho percorrido e fundou os alicerces da participação da sociedade civil na solução de casos trabalhados pelo NPA, materializando o festejado Princípio Constitucional da Democracia Participativa. O abandono das antigas práticas obsoletas de exclusividade do Poder Público Municipal atesta o caráter multidisciplinar do Direito Animal e confere perfeita aura de legalidade à improvisação em caso de situações inusitadas, v.g, afastar o animal ainda durante a investigação policial de seu proprietário e entregá-lo a um protetor, a fim de lhe salvaguardar o bem-estar e na maioria das vezes, sua própria vida. A metodologia utilizada encontra embasamento não somente em espirais teóricos como livros e artigos de revistas especializadas, sites de ONGs e protetores independentes, mas principalmente na pesquisa de campo através da observação sistemática durante o lapso temporal em que a autora foi titular da 19ª Promotoria de Investigação Penal que abrangia a 32ª Delegacia Policial (Jacarepaguá) e Delegacia de Proteção ao Meio Ambiente que abarcava o NPA.

The present work focus on the success of the partnership of the Animal Protection Center (APC) of Rio de Janeiro with the emerging class of "Protectors", lato sensu, including in this context the NGOs that operate in this area. After a perfunctory historical tour about the emergence of this new segment of animal protection, we sought to identify the positive aspects derived from this unprecedented alliance, without overlooking the approach as to its regularity and legality in the face of international standards, especially the Universal Declaration of Animal Rights (U.D.A.R) and internal legal order, it is worth saying, the Brazilian Magna Carta of 1988 and other infraconstitutional legislation that deals with the subject. The Theory of Social Movements made a great contribution in the path traveled and founded the foundations of civil society participation in the solution of cases worked by the APC, materializing the celebrated Brazilian Constitutional Principle of Participatory Democracy. The abandonment of the old obsolete practices of exclusivity of the Brazilian Municipal Government attests to the multidisciplinary character of Animal Law and gives a perfect aura of legality to improvisation in case of unusual situations, e.g., to remove the animal even during the police investigation of its owner and deliver it to a protector, to safeguard its well-being and most of the time, its own life. The methodology used is based not only on theoretical spirals such as books and articles from specialized journals, websites of NGOs, and independent protectors but mainly on field research through systematic observation during the time-lapse in which the author was the holder of the Brazilian 19th Criminal Investigation Prosecutor's Office, covering the 32nd Police Station (Jacarepaguá) and the Environmental Protection Police Station that encompassed the APC.
