O texto discute a possibilidade da aplicação da teoria da desconsideração da pessoa jurídica em benefício da pessoa singular do sócio, com base nos comandos constitucionais portugueses da dignidade da pessoa humana, desenvolvimento da personalidade pelo trabalho e da livre iniciativa. Fez-se o caminho interpretativo que se iniciou no ordenamento comunitário, que é o tratado de Lisboa, o ordenamento constitucional português, terminando com a análise dos dispositivos infraconstitucionais do Código Civil, do Código das Sociedades Comerciais e do Novo Código de Processo Civil. A exegese dos preceitos de forma conjugada foi confrontada com julgados do Superior Tribunal de Justiça do Brasil, bem como de Tribunais da Relação de Tribunais Portugueses, os quais adotaram, de forma não explícita, da desconsideração da pessoa coletiva em benefício da pessoa singular do sócio.

The text discusses the possibility of applying the theory of disregard of the legal person to the benefit of the individual¿s partner, based on the Portuguese constitutional commands of the dignity of the human person, personality development through work and free initiative. The interpretative route that began in the community system, which is the Treaty of Lisbon, the Portuguese constitutional order, ended with the analysis of the infra-constitutional provisions of the Civil Code, the Commercial Companies Code and the New Code of Civil Procedure. The exegesis of the precepts was combined with judgments of the Superior Court of Justice of Brazil, as well as Courts of Relation of Portuguese Courts, which adopted, not explicitly, the disregard of the legal person for the benefit of the natural person of the partner.
